Measures for the Administration
on National Accreditation Body
Article
Article 2 The term “national accreditation system” in this Measure means a system which implemented by State and supervision on certification bodies, laboratories, certification training bodies, and certification personnel.
Article 3 This term “national accreditation body” in this Measure means the body authorized by State and who engage in certification body accreditation, laboratory accreditation, and certification training and certification personnel accreditation.
Article 4 CNCA is exercise administrative responsibilities by undertaking unified management, supervision and overall coordination of certification and accreditation across the country, and fulfills the following responsibilities for establishing and implementing national accreditation system:
(1)To be responsible for establishment and implementation of national accreditation system;
(2)To develop the basic requirements for national accreditation body;
(3)To be responsible for establishment, authority and administration of national accreditation body;
(4)To declare the catalogue of national accreditation bodies and relevant information;
(5)To develop and declare the national accreditation mark;
(6)To administer international cooperation in accreditation scope.
Article 5 Relevant administrative departments of State Council join the establishment and implementation of national accreditation system through the following methods:
(1)To makes a suggestion and opinion to CNCA through inter-ministry joint meeting system under the unified management, supervision and overall coordination by CNCA;
(2)To guide and supervise the business through the related committee of national accreditation body;
(3)To let the industry and the department have a use of the national accreditation system, and push the development of certification affairs.
Article 6 CNCA shall establish unified national accreditation bodies which fulfill national accreditation function in accordance with international current rules.
Article7 CNCA will assess the establishment of national accreditation body.
CNCA will issue the authority certificate of national accreditation body after assess the basic requirement, capabilities and structure, rules of its related committee.
Article 8 National accreditation body shall meet relevant international rules and following basic requirements:
(1)Having legal person status which engages the civil legal obligation independently;
(2)Having the principal and procedure which ensure fairness, and implement to manage with a fair way;
(3)Having a policy that will ensure its fairness which include rules that national accreditation body guarantee fairness of certification activities, appeal, complaint procedure of related accreditation affairs and so on, and to ensure relevant party shall join the establishment and implementation of accreditation system;
(4)To prepare enough personnel according to accreditation scope and workload which its education, training, technical knowledge and experience will satisfy with accreditation request.
(5)To ensure the manager and all personnel from any pressure either from business, financial affairs or any other aspect that might affect the accreditation result.
(6)To ensure its relevant body’s activities don’t affect security, objectivity and fairness.
Article 9 The following activities of national accreditation body shall ask CNCA for permission:
(1)To join relevant international activities, and vote on important items to international bodies;
(2)To sign international bilateral agreement or multilateral agreement.
Article 10 The following activities by national accreditation body shall send a written report to CNCA:
(1)Development and revision of accreditation rules (requirements);
(2)An important meeting;
(3)Change of main manager;
(4)Approval, suspend and cancel of accreditation;
(5)Important appeal, complaint and investigation result;
(6)Other important matters.
Article 11 CNCA shall implement administration on national accreditation body and accreditation system through the following methods:
(1)To implement annual assessment and daily supervision on national accreditation body;
(2)To implement the administration for accredited certification bodies, laboratories, and training bodies;
(3)To implement the administration for certified units;
(4)To implement the administration and spot check on certified products;
(5)To implement the supervision for accredited certification personnel.
Article 12 CNCA shall accept the complaint and appeal to national accreditation body and accreditation quality, and organize to investigation and treatment.
Article 13 Where a national accreditation body disobeys relevant international rules and relevant regulations by CNCA, it shall be ordered to make corrections and its principal shall be given a warning.
Article 14 Where a certification body, laboratory, certification training body and certification personnel accredited by national accreditation body disobey accreditation rules or relevant regulations by CNCA, it shall be ordered to suspend or cancel the certificate of relevant bodies, personnel by CNCA.
Article 15 CNCA will be responsible for the explanation of this Measure.
Article 16 This Measure will be implemented on May 1, 2002.
