Chapter 1

General Provisions

Article 1

In order to improve the security sanitary level of feed quality, to regulate the feed quality certification, to promote the development of feed industry and breeding industry, to protect the human health, this measure is formulated in accordance with the Regulations of the People’s Republic of China on Certification and Accreditation, Regulations on Control of Feeds and Feed Additives.

Article 2

The term “feed products certification” in this measure means the enterprise voluntary registration, and it is a conformity assessment activities by a certification body to assess the feed and feed additive and its manufacture procedure in accordance with relevant standards or technical regulations.

The object of feed products certification include feed products related to single feed, additive premix, concentrate, formula feed, concentrate supplement and feed additive products related to nutritive feed additive and general feed additive (hereinafter referred to as feed products)

Article 3

Any person who engages in feed products certification and its supervision shall comply with this measure.

Article 4

Certification and Accreditation Administration of the People’s Republic of China(hereinafter referred to as CNCA) and Ministry of Agriculture are responsible for management of feed product certification and quality supervision in accordance with “SanDing” project by State Council.

Article 5

A certification body to be established may engage in feed product certification activities within the approved scope only after it is approved by the CNCA.

Article 6

Feed products certification shall adopt the unify certification standards, technical regulations; conformity assessment procedure, and label unify feed products certification mark (hereinafter referred to as certification mark).

第七条 国家鼓励饲料企业申请饲料产品认证。

凡实行生产许可证和批准文号管理的饲料和饲料添加剂，饲料行政管理部门可以凭认证机构颁发的饲料产品认证证书向获证企业免检换发产品批准文号。

Article 7

Chapter Two

Implementation Organization

Article 8

CNCA formulated the Implementation Rule of Feed Product Certification jointly with Ministry of Agriculture.

Article 9

A certification body, certification personnel who engage in feed products certification (hereinafter referred to as certification body) and inspection body who undertake the inspection task of feed product certification (hereinafter referred to as inspection body) shall comply with relevant laws, administrative regulations and technical rules.

Article 10

A certification body shall fulfill the following responsibilities:

（一）To perform certification according to their approval business scope following regulations;

（二）To issue or cancel certificate of feed product for certified feed product in accordance with regulations, and to permit or suspend to use certification mark.

（三）To undertake follow-up inspection on using situation of feed certification mark;

（四）To exercise follow-up surveillance of persistency of certification product;

（五）To accept CPCS-related appeals and complaints.

Article 11

Feed product certification shall exercise the combination certification model of sample testing, on-the-spot inspection and follow-up surveillance.

Article 12

Any unit or individual (hereinafter referred to as applicant) who apply for feed product certification shall submit a written application to a certification body.

Article 13

A certification body shall, within specific period from the date of acceptance of the application complete reviewing of the said application files. If the files are not in accordance with the requirements, it shall notify the applicant in writing.

Article 14

A certification body shall inform applicant of the documents accord with the requirements, and assign certification personnel to take a on-the-spot inspection on manufacturing environment and manufacturing procedures, and assign testing body to take a sample testing.

Article 15

A certification body shall exercise a overall evaluation in accordance with certification basis regulations and certification rules if the on-the-spot inspection and sample testing accord with the requirements, and issue certificate of feed product in a specific time.

If unconformity with requirements, it shall notify the applicant in writing.

Article 16

A certification body shall exercise timely follow-up surveillance on product’s persistency, and also shall exercise the irregular follow-up inspection in accordance with the situation.

Article 17

If the applicant disagree the decision made by certification body, they shall appeal to this body, if the applicant still disagree the disposition, they shall appeal or complain to CNCA directly.

Article 18

CNCA and Ministry of Agriculture shall promulgate the list of certified feed product timely.

Chapter 3

Management of Certificate and Mark

Article 19

Certificate of feed product is a proof document that the feed product which comply with certification requirements and permit to use certification mark. Certificate form of feed product shall comply with relevant regulations by State, and issue by certification body.

The certificate should include the following information:

（一）Applicant;

（二）Product name, type and series;

（三）Manufacturer and its factory (factories);

（四）Model of certification;

（五）Referred technical regulations and standards;

（六）Date of certificate being granted and validity period;

（七）Issuing body and certificate No...

Article 20

Basic Pattern, color of certification mark

It has to indicate the name of certification body under the certification mark when using certification mark.

Article 21 The applicant who get the certification of feed product (hereinafter referred to as certificate holder) shall print the certification mark on certified products or its cover, and accept the follow-up inspection by certification body.

Article 22 The certification body should revoke and take back the certificate:

（一）There are some changes in the standard, and whereby the product can not qualify for the changes or modifications;

（二）The certificate holder failed to prolong the certificate;

（三）The production of the certified product has terminated;

（四）The certificate holder applied to cancel the certificate.

Article 23 The certification body should suspend the use of the certificate and certification mark in the event any of the following situations arise:

（一）The certificate holder uses the certificate of certification mark in violation of relevant requirements;

（二）The certification holder violates the requirements of the certification body;

（三）The follow-up surveillance indicates that the certified product failed to meet the certification requirements, but not serious to the extent as to lead to the immediate withdrawal of the certificate.

Article 24 The certification body should withdraw and take back the certificate in case any of the following situations arise:

(一）The follow-up inspection shows that the product bears major defects;

(二）During the period when the certificate is suspended, the certificate holder failed to take adequate corrective action;

（三）The certified product caused a serious quality, security and sanitary accident of major defects.

第二十五条 认证证书持有人在获得认证的产品或者其包装物上标注认证标志时，可以根据需要等比例放大或者缩小，但不得变形、变色。

Article 25

Certificate holder shall scale up or reduce in scale in accordance with the requirements, but

Any unit or individual have not to falsification, modification, trading or transfer of the certificate and certification mark of feed product.

Chapter 4

Supervision and Administration

Article 27

CNCA and Ministry of Agriculture shall exercise supervision and administration on manufacture, sale and usage of certification mark by law.

Article 28 The certification body and inspection body shall abide by the following rules:

（一）To exercise certification, testing and inspection affairs in accordance with relevant law, administrative regulations;

（二）To guarantee the objective, fairness and honest of certification, certification testing, certification inspection, and to engage in related legal responsibility;

（三）To keep the business secret and technical secret of certified products. Illegal use of the scientific and technical achievements is prohibited;

（四）Consultancy or product development within their respective designated business scope of certification is prohibited;

（五）To join the relevant enforcement department in their efforts to eliminate illegal practices.

Article 29

The certificate holder shall abide by the following rules arise:

（一）To guarantee working environment necessary for certification, and to accept the surveillance and follow-up inspection by the certification body;

（二）To ensure the certified products meet relevant national standards and technical regulations are on a continuous basis;

（三）To ensure a correct use of the certificate and certification mark in promotional materials, such as any advertising or leaflet of the products, so that the consumers are not misguided or cheated;

    （四）To accept the supervision and inspection by relevant enforcement department.

第三十条 对违反国家有关法律、行政法规规定的，依照法律、行政法规规定处罚。

Supplement Provisions

Article 31

Structural fee charts for certification and inspection of feed product shall be in conformity with the relevant laws and administrative regulations of the State Council on pricing.

Article 32

CNCA and Ministry of Agriculture are responsible for the explanation of this measure.

Article 33

This measure shall come into effect from the date of promulgation.
